Possession – Your Side

Landlords often purchase residential properties for investment purposes believing that renting a property is a smooth process.  The regulation of residential landlords is high on the government’s agenda and tenants’ rights are well protected by the current Housing legislation.

Problem tenants are a serious obstacle to professional landlords and the occasional property investor alike.  Persistent delays in paying rent can often lead to banks and building societies enforcing their right to a repossession of the rented property, involving a landlord in substantial expense and reducing the profits envisaged from an investment property.

We understand how stressful it can be to recover possession of your property from a tenant.  The legislation is designed to punish even the slightest mistake by a landlord in relation to the service of a Notice to Quit or the proceedings themselves.

Our experience is particularly important in today’s financial climate, when pressure is increasingly on landlords to generate profits from their assets.  This means efficiently removing tenants who refuse to pay or persistently delay in paying rent, or those causing damage to the property.  The reality is that locating a tenant after they’ve left the property is often not cost effective and the steps necessary to recover rent arrears must be taken before a tenant is required to leave.

At BTMK, we understand the importance of moving quickly and decisively in order to serve the appropriate notice and put in place steps to recover possession of your property.  We also know that it is equally important that the landlord is fully aware of what the process will cost and the timescales involved.  We also recognise that the landlord or their agent  may already have served a Notice to Quit and want to use only isolated parts of the service that BTMK is able to offer.  With this in mind, we are pleased to announce that we now offer a fixed fee structure for the recovery of possession of residential properties, details of which can be found overleaf.

The majority of possession claims will fall within our fixed price structure.  Naturally, some possession claims will fall into the “exceptional” category – if this is the case in relation to your claim for possession, we will notify you at the outset and agree a reasonable fee to deal with your circumstances.
